Military Benefits,When should they stop?

Someone i know was married to a navy man for 26  years and recentlyin divorce preceedings,he is threatening to take all benefits,is this fair? she was with his guy almost three decades , shouldnt she at least be entitled to commisary priviledges!

I hate shopping at the commissary! People are rude and always in your way! The baggers are horrible and then your expected to tip them since they dont get paid. I would rather shop at the grocery store down the street from me!

It doesn't matter what he is threatening to take away. Military guidelines are VERY clearcut. When a divorce occurs, the spouse who is not in the military loses all on base priveleges, period. This includes housing, commissary, and health/clinic benefits. I know because my step-daughter went through this a year ago in Florida. The good thing (if there is one about a divorce) is the military will make absolutely sure that child support is taken out of paychecks if minors are involved. They do not tolerate non-custodial parents shirking their obligations.

I think the problem is that people watch tv too much,every divorce doesn't end up with half and half.but to be completely fair i dont think anyone is entitled to anyone else funds,properties, or investments,married or not.its sad that it does happen though,and if he divorced his wife then she wasnt doing something right, so she should get a big ZERO,reminds me of the little red hen,So No you cant have any of my bread you didnt help me make it.

she can fight it in court and she can get alimony.  i am going through a divorce right now and my husband is military.  they said it was up to me if i want the benefits and alimony, i chose no.  i want him to give everything to our children that he can.  he wants me to take the benefits, but i dont want to.  tell her to fight it.  with the time they were married she should be wntitled to alot.

Just because he is divorcing her doesnt mean she did something wrong. He could have changed a lot and just didnt see a life with her anymore, or it could be something he has done.

Totally second that. Too many people rely that the government will bail them out of anything.

state laws regarding divorce and your "rights" vary -
some states are 50/50 and others are more subjective.
even in those that are 50/50 states - if the couple makes agreements then that trumps everything

I agree.  I was in the military for a long time, and saw lots of abuse go on (on both sides), and then it happened to me. Don't forget you can go to the courts also to get what you deserve.

Here's the deal on what an ex-spouse is entitled to when they divorce a military man. They lose all privileges to commissary, medical benefits, and access to military bases. If alimony is granted through the courts, she will get that as it will be taken out automatically from her ex-spouse's paycheck. She can also fight in the courts for her exes life insurance and survivor benefits too. I think it's sad that this couple has to end a 26 year marriage. Best of luck to both of them.

Hmm, I think the person who actually served should get the benefit for life, but when the couple splits, the benefit should stop.  Alimony or whatever should be settled just like anybody's else's. Cash only but not on the dole of the rest of us.  The spouse is no longer in the military.  Just my opinion.
