This Is A Hard One!!
« on: October 08, 2010, 02:04:12 am »
Conjoined Twins - What if one commits a crime (say, like, shoplifting, or an assault), how can justice be put into play? or what if one commits a crime against the other? How would the justice system work for them?
Also.... what if one wants to have sex and the other dosen't? that would be like rape on the other one wouldn't it? or getting married? isn't it injustice for one to marry and the other disapprove. or would it be polygamy? And if the ones husband has sex with her, isn't he committing adultry by having sex with the other at the same time?
it's hard for me to wrap my head around it. maybe you guys can help? :dontknow:

Let's think about this logically for a minute...and correct me where I'm wrong, because I'm not researching on this, just speaking about what makes sense to me...

How often are conjoined twins born where they are not separated?  How often, when they are not separated, do they survive?

The common interpretation for our legal system is that we would rather allow the guilty to go free than to imprison the innocent.  But you also have to think about this...if one of the twins did something, the other would be looked at the very least as an accessory, since there was no way of them not knowing what was going down...especially once the crime began.

I think they work together as far as the marriage and sex goes...it also depends on how the are joined. Some have seperate genitals, some don't.
I mean two heads on one body, i probably should have been more specific. and amy, i know it's highly unlikely for the case to ever occur, but it's still a possibility and i wonder how the justice systremwould work for them. but amy, what if one twin commits a crime against the other?

Highly unlikely, but has in fact occured. Here is one case that has been prominant as far as news and journals. I am going outside my norm and using wiki because, in this case, it has correct info:

I guess they'd be screwed...LOL.

But, like the case both Marie and Jordandog brought up...it seems that they would be so in sync with each other...everything Abby and Brittany say about their future is "we".

Um, then why did you bother to write this?

Looking at Abby and Brittany then...

They would have to work together to commit a crime.  Abby cannot feel the arm on Brittany's side of the body and vice versa.  The mother spoke of them lying down together and poking parts of their body and where the sensation of feeling began and ended for each.  They spoke together about motherhood, and said we want to be moms, but we're only 16 so we're not going to worry about it yet.  They took the driver's exam together, but twice.  At this level, it seems logical that if a crime were to be committed, they would have to cooperate with one another...and it would go against their survival instinct to try to harm the other.  Or...even look at suicide...if one were to want to kill herself, she would most likely take her sister with her.  It seems the very essence of their survival is their cooperation.  They would be tried together (groups of two or more have been tried as co-defendants before...there is precedence for this much.).  But to try one and the other is innocent...it seems most likely that they would both go free, because of the imprisoning the innocent concept.  I don't see it as likely at all for a crime to be committed, though, without at least the knowledge it was to occur, therefore, the twin would be an accessory and therefore would receive punishment as well.

As convoluted as that is, that is my take on the situation.

Here is an article about Siamese Twins Chang and Eng, who toured with the Barnam and Bailey Circus.  They even married and raised children between them....quite interesting.

Amy, your explanation actually makes the most sense.

What if abby used her arm single-handedly to commit murder?

Well, if one twin committed a crime the other would technically be  and accessory.  I guess it would depend on how they were joined and which twin controlled what.  But it is an interesting question its not like they can put one in jail without the other without separation.
