"New Jersey Court Rules Spousal Abuse Acceptable Under Islam"

This judge held that the defendant could not be held responsible for the violent sexual assaults of his wife because he did not have the specific intent to sexually assault his wife, and because his actions were "consistent with his [religious] practices." In other words, the judge refused to issue the permanent restraining order because under Sharia law, this Muslim husband had a "right" to rape his wife.

SO..... when did the U.S. become answerable to Sharia Law? IS THIS STILL AMERICA OR WHAT??? We have gone absolutely nuts trying to appease muslims or any other "religous" group.

I'm with you on the US not needing to bow down to Sharia law, however...

Under those circumstances, the court finds that a final restraining order is not necessary to prevent another act of domestic violence. The Court will not enter a final restraining order.


Nonetheless, the judge cautioned defendant not to have any contact with plaintiff and to instruct his family members and friends to have no further contact with plaintiff's family. Additionally, the judge acknowledged that the two would have to be involved in litigation over the baby and child support.

As a final matter, the judge recognized the pendency of a criminal action against defendant, and indicated its existence constituted an additional basis for the judge's ruling denying a final restraining order, since he assumed that a no-contact order had been entered as a condition of bail.

I'm not entirely convinced that the judge's ruling was based solely upon Sharia law.

I know this will sound bad, but I think he had the right to do that.  I definitely disagree that the US should bow down ot Sharia law.  This isn't a Muslim country.  It's a melting pot.  American also promises guaranteed freedom of religion.  Sharia law is part of Islam, so techinically the muslim man had every right to treat his wife the way he treated her.

This is an unfortunate drawback of having freedom of religion. But no one should really worry because these situations are far from the norm in this country. Ultimately if the woman has the guts and brains to stand up and leave her husband/religion, she has every right to do so and anything that happens to her will be dealt with according to US law. Where did you find that site, Falconer?  That was very informative and interesting.  I hope they are able to really help a lot of people out of the situations they are in.  I hope Miami can get their ads going again, too. It's good there is an American group willing to go out on a limb like that to help these people.

Ultimately if the woman has the guts and brains to stand up and leave her husband/religion, she has every right to do so and anything that happens to her will be dealt with according to US law. Sometimes leaving the abusive husband or boyfriend doesn't help....religion or not.  There have been women that have a court ordered "restraining order" in their hands.....when the man decides to murder them.  Sometimes it doesn't matter what kind of court protection she has if he really wants to get her, he will. That "Restraining Order" is only good if the officer(s) catch him violating it.

We need stricter laws for domestic violence, and more safe haven houses for abused women and their children to flee to.  This charity is worthy of donation.  Almost every town has a woman's shelter.

Absolutely spot on with your words, Annella. You are so right. That piece of paper means nothing as has been shown thousand of times. I have seen the same women show up repeatedly in our E.R., literally beaten to a pulp, while carrying a 'Restraining Order' on their person. The police do nothing more than say they will see them in court because they really cannot do anything but that. It makes me furious and something needs to change. I give clothing, food, diapers, formula, and money to our 2 women's shelters in my city. They do a wonderful job, but beds and resources are limited, especially when they have to bring their children with them. I have gone through abuse, but am thankful every day that I was able to remain in my home with my sons and that my ex decided to disappear.

under the bible's law, you can have slaves, kill certain people, etc... we know some of the things in every holy book is wrong, but religious people can't accept the fact that they could be wrong.

This is something I see all the time.  I'm sure you do also in your profession. Our shelter here is always full and has a waiting list.  How do you tell a woman that there's no place for her and her children when she's afraid for her life and her kids?  We are trying to build another one but need more financial support.  Being a victim of abuse myself (like you), I know the absolute fear of not knowing where to go, or what to do, and my restraining order did not keep him away.  He finally found someone else to abuse.  It's a vicious cycle.  Your right, something has to change.  Thank you for your help jordandog, and I encourage anyone reading this, that your donation to any woman's shelter could be saving lives.....literally.

Oh I agree. The point I was trying to grasp at was one can only take freedom of religion so far in this country. When the practices tell you to murder people who view you as dangerous due to a decision, that's not going to hold up well in any court. Unfortunately I cannot say much for other countries.

Jiu-jitsu, mace, tazer, knife, or pistol! Seriously though, I would highly suggest finding a teacher who's willing to volunteer Jiu-jitsu classes to the abused women you come across.
