" The Timbisha Shoshone Tribal Council has asked for the Indian Law Resource Center's help to invalidate an act of Congress that confiscates a fund of money belonging in part to the Tribe.

The U.S. Constitution forbids the government from taking any property without just compensation and due process of law.  But Congress believes this rule does not apply to property belonging to Indian tribes.  Congress claims "plenary power" over Indians and their property - power to do whatever it wishes with Indian tribes, lands and money. 

The "plenary power" doctrine is so outrageously discriminatory that many have compared it to the "separate but equal" doctrine and the Jim Crow laws that treated blacks as racially inferior until the 1950's.  We hope the Timbisha case will change that and protect Indian property. ......"
